Introduction:
PCO Auction is owned and operated by Personal Choice Outfitters, LLC (PCO INTL). The sole intention of the auction & classified service offered by PCO Intl is to allow consumers an avenue of consignment for their used items. The items and services sold on PCO Auction & Classifieds is for used items only, and is not intended for retailers, manufacturers, wholesalers, or distributors of any type.
Revisions:
PCO Intl, reserves the right to change polices and pricing structures without notice.
Eligiblity for Membership:
Only those individuals who can form legally binding contracts under all applicable laws are eligible to become members of the PCO Auction website. This portion of the PCO INTL website is not intended for minors. Any person found to attempt to forge or lie about their eligibility will have the account canceled and reported to local authorities. PCO Intl prohibits manufacturers, retailers, wholesalers, or distributors of any type from becoming members and posting auction listings on PCO Auction. By registering with PCO Auction you validate that you are an eligible individual, and will follow all Federal, State and Local laws. You are confirming that you are intending to buy and sell items and services that are deemed legal, only. All members are required to post truthful and accurate information about them self upon registration. Members are prohibited from changing information at a later date to untruthful or inaccurate content. False listings will be reported to local authorities for review of Fraud. Violators will be prosecuted to the fullest extent of the law.
Disputes & Account Cancelations:
Any disputes, questions or concerns need to be resolved with the seller of the item. PCO Intl does not accept liability for undelivered or damaged items. Reports unethical practices can be placed with PCO Intl management against the seller for future sales. PCO reserves the right to cancel any seller or purchasing account, without notice.
Bidding:
Placing a bid with PCO Auction is irrevocable offer to purchase the item(s) selected, as long as the bid is the winning bid when the auction has closed. The winning big is the highest bid offered for an item. If the same amount is offered for the same item, the winning bid would go to the earliest posted bid. Place a bid is considered a legally binding contract. Bids might be subject to a minimum bid based on the sellers posting. Bids cannot be removed without the permission of the seller. Any disputes must be worked out between the seller and the buyer. PCO Intl will not act as a mediator. By bidding on an item you authorize PCO, Intl to release your contact information to the seller. The released information will include name, address, email address, and telephone number.
NOTE: DO NOT PLACE A BID UNLESS YOU INTEND TO PURCHASE THE SELECTED ITEM FOR THE AMOUNT YOU HAVE BID. AUCTION TIMES WILL NOT BE EXTENDED DO TO UNFORSEEN OR TECHNICAL DIFFICULTIES. BIDERS ARE ADVISED NOT TO WAIT UNTIL THE LAST MINUTE.
Listing:
Placing an item for auction is an irrevocable offer to sell an item to the winning bidder. The seller is required to transfer ownership of the auction item to the highest bidder. In the case of a tie the breaker would be decided based on the earliest bid submission. It is the seller’s responsibility to incur all cost and complete all processes required for shipping of the item. Listing an item constitutes as entering into a legally binding agreement. Do not list items you do not intend to sell. Seller need to ensure they are not infringing upon copy right, trademark, or patents when making their listing. Responsibility of infringing on intellectual properties or not be an authorized seller of any item or service is that of the seller. PCO Intl does not accept responsibility for any illegal or unauthorized activity by the seller or purchaser. All descriptions of items must be truthful and accurate. ALL CAPS postings are prohibited. Sellers must list a specific item or service for bid. Only one listing per item listed for sale, if a specific quantity of items available the quantity should be listed within the one listing, duplicate listings will be removed.
Restricted Items:
PCO Intl prohibits the sale of any illegal item or service. PCO Intl reserves the right to remove any listing without notice. PCO Intl also prohibits the sale of sexually explicit items or services. Any postings of absence sexual services or materials, including but not limited to prostitution or child pornography will be reported to the local authorities. The sale of hazardous chemicals, stolen or counterfeit goods, body parts, humans, human remains, live animals drugs, bulk emails, voter preferences, kits and devices used to commit an illegal act, instructional material that describes how to commit an illegal act-build a bomb or convert a firearm to fully automatic, nuclear materials, nuclear building instructions, terrorist related information or material, illegal firearms are also prohibited. PCO Intl prohibits the sale of software or other electronics items which contain viruses, adware, worms, Trojans or any other hazardous context that may harm the purchaser’s equipment. The above list is a general guideline but not a full listing of restricted items. Sellers who are unsure of the eligibility of items should contact PCO, INTL before posting their item. Any attempt to conduct an illegal, straw or otherwise, firearms transfer will be reported to the local authorities. PCO will fully participate with authorities in the case of illegal activity taking place on PCO Auction or any other section of the PCO Intl website.
NOTE: Sales of all items must comply with all federal, state and local laws. It is the responsibility of the buyers and sellers to locate FFL dealers to complete a firearm transaction. Fees charged by an FFL dealer are not the responsibility of PCO Intl.
Privacy:
PCO Intl will only release the sellers contact information to the winner bidder. PCO Intl prohibits the purchaser to use the sellers contact information for any other purpose other than to complete the transaction.
Payment:
All payment is paid in the currency of the United States Dollar. PCO Prohibits any posting of items or services which by passes the final value fee or any other fee charged by PCO Intl. Payments are accepted by credit card, debit card, money order, or check. All checks are held until they clear. Buyer is responsible to pay the estimated shipping and insurance costs listed by the seller. Payment must be received within 10 days of initial contact with the seller. No warranties are issued for products sold on the PCO Auction website by PCO Intl. Other PCO warranties and guarantees do not apply to PCO Auction. The seller may hold checks for up to 7 days to ensure a check clears before shipping an item. No transaction should take over 30 days to fully complete. Sellers are required to ship items promoted upon the check clearing. Sellers are required to make payment immediately to PCO Intl upon receipt of any purchaser checks for PCO final value fees, or other assessed fees. Any seller found avoiding payment of fees to PCO Intl will result in immediate cancelation of their account. PCO Intl will pursue any outstanding balances owed. All payments are final and are non refundable.
NOTE: PCO Intl, recommends insuring all items shipped along with a signature verification. PCO Intl recommends the seller using Escrow services for all land auctions. It is up to the seller make escrow arrangements. Returned checks will result in a $25 return check fee charge.
Alterations:
Purchasers and sellers are prohibited from altering any rules of the auction website.
Firearm Transfers:
It is the responsibility of the buyer and seller to locate an FFL dealer. All ATF regulations, Federal, State and Local laws apply to the firearm transfer. PCO Intl does provide FFL dealer services openly on PCO Auction. Sellers and purchases located near a PCO Intl location may contact the management team to arrange specific FFL transfer deals, at $20 per firearm transferred.
NOTE: Sellers and purchasers beware age verification maybe necessary before certain other items can be shipped, such as knives and ammunition. Contact your local authorities for more information. Additionally the sale of some items may be prohibited in some states, confirm eligibility with local law enforcement before post an item for auction or bidding. Verification is the responsibility of the seller and purchaser.
Side Deals:
PCO Intl prohibits any transaction between non winning bidders and a seller, such activities does not follow the rules of the PCO Auction. Individuals who are found to be conducting in side deals do not qualify for any of the PCO Intl guarantees for those transactions and will have their account canceled immediately. PCO Intl is not liable for any wrong doing encountered by any side deals.
Non United States Sellers & Purchasers:
PCO Intl allows non United States residents to participate on the PCO Auction website. Individuals not living in the United States are expected to follow all United States Laws, including import and export laws, in addition to their own countries Federal, State and Local Laws. PCO Intl prohibits any illegal activity being conducting on its website regardless of the individual’s country of origin. Violations will be reported to local authorities. All non United State residents are responsible for import, export, and tariff fees. PCO Intl reserves the right to void any sale in which the item is located outside the United States. Any listing where the country of origin is not clearly listed PCO Intl reserves the right to remove. All removals of accounts and listings can be conducted without notice. Purchasers who have bought an item not residing in the United States must legally import to the United States. All FFL dealers must file appropriate documentation with the US Customs. Failure to file appropriate paperwork with US Customs will result in the confiscation of the firearm by US Customs.
Fraud Prevention:
It is very rare that PCO Intl receives any complaints of fraud. To assist buyers against fraud PCO Intl offers the PCO Auction Protection Plan. To be eligible for the plan you must be the winning bidder. The transaction can not involve a Side Deal. If the buyer does not receive the item purchased or if the item is not materially different from the description listed on PCO Auction the buyer has 60 days to place a claim by phone, email or mail with PCO Intl management. After review of the claim if it is found legitimate and is not resolvable with the seller, the seller is eligible to recover up to $500 dollars of their purchase with a $100 dollar deductable. This would mean if the purchase was for $500 and the claim was determined by PCO Intl management to be legitimate the buyer would receive $400. Checks would be issued within ten days of the claim being verified. Verification of payment and non receipt of item must be provided for claim. Demonstration of item discrepancy must also be provided for the claim. This program is for extreme issues only, general disputes must be resolved between the buyer and the seller. PCO Intl will not arbitrate a dispute. PCO Intl will terminate in users account if found to be involved or convicted of fraudulent activities. The manipulation of bids in any form is prohibited by PCO Intl. No shill bidding allowed on PCO Auction. Any user found to be manipulating bids will have their account closed.
NOTE: PCO Intl recommends all purchasers to never use cash as payment or any other method that cannot be verified for proof of payment. PCO INTL reserves the right to refuse service to anyone. PCO Intl will terminate buyer accounts it is found the individual is making bids and not completing transactions.
Auction Content:
PCO Intl is not responsible for the content posted by users of the website. It is up to the user to review all posted content to ensure it is accurate, appropriate and legal. Users must follow all Federal, State and Local laws.
Security:
PCO Intl prohibits the sharing of accounts, and passwords. PCO Intl recommends changing your password at any point you believe you password has been comprised.
Agreement:
By continuing the registration process of PCO Auction you agree to all terms listed by PCO Intl. By using PCO Auction you agree to follow all PCO Intl rules, Federal, State and Local Laws. PCO Intl reserves the right to cancel any account at anytime without any notice.
